1. Scope of application
The following terms and conditions apply to all orders placed by consumers and entrepreneurs through our online store.
A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.
The following applies to entrepreneurs: If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby objected to; they will only become part of the contract if we have expressly agreed to them.
2. Contractual partners, conclusion of contract, correction options
The purchase contract is concluded with AYURDEVA Vertriebs GmbH.
By placing products in our online shop, we are making a binding offer to enter into a contract for these products. You can place our products in your shopping cart without obligation and correct the information you have provided at any time before submitting your binding order by using the correction tools provided and explained in the order process. The contract is concluded by you accepting the offer for the products contained in the shopping cart by clicking the order button. Immediately after sending the order, you will receive another confirmation by email.

We store the text of the contract and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

5. Requirements and handling of customer content
5.1 Requirements
If it is necessary for you to provide us with content (e.g. texts, data, files) in order for us to fulfil the order, the technical options available for this and any applicable requirements shall be based on the respective product description.
You are solely responsible for the content, including the legality and correctness of the content you transmit. We do not carry out any editorial checks of the content before the order is executed.
5.2 Compliance with applicable law
The content and the products created from it must always comply with the applicable legal provisions. In particular, they must not violate any rights or claims of third parties (in particular copyrights, trademark rights or other property rights) and must not contain any content that glorifies violence, is discriminatory, racist, xenophobic or otherwise contrary to public decency or the constitution, nor serve any such purpose.
5.3 Indemnity
You shall indemnify us against any third-party claims that may be asserted in connection with an infringement of their rights as a result of our contractual use. You shall also bear the necessary costs of legal defense, including all court and attorney fees at the statutory rate. The exemption does not apply if you are not responsible for the infringement. You are obliged to provide us immediately, truthfully and completely with all information necessary to examine the claims and mount a defense in the event of a claim by a third party.
5.4 Right of withdrawal
We reserve the right to refuse the order or to withdraw from the contract if the content you have provided for this purpose violates legal or official prohibitions or is contrary to public decency, or if there is reasonable suspicion in this regard. This applies in particular to the provision of anti-constitutional, racist, xenophobic, discriminatory, offensive, youth-endangering and/or violence-glorifying content.

Delivery options
We ship the products to the delivery address provided during the ordering process.
You may also pick up your order at AYURDEVA Vertriebs GmbH, Wendelins 1b, 87487 Wiggensbach, Germany during the following business hours: 8:00 a.m. - 4:00 p.m.
7. Payment
7.1 Prices
The prices stated at the time of the order shall apply. These are total prices and include the statutory VAT.
7.1a Deliveries to third countries
We do not charge VAT for deliveries to third countries (non-EU countries), provided that the legal requirements for a tax-free export delivery are met. The customer is responsible for all import duties (import sales tax, customs duties) in the recipient country.
We do not offer the tax-free procedure with VAT refund using special forms for non-EU citizens. Subsequent issuance of tax-free forms or similar documents is excluded.
7.2 Due date and default of payment
The price is due upon conclusion of the contract, unless a later point in time arises from the following terms of payment.
The following applies to consumers: In the event of default in payment, we reserve the right to charge you a fee of €1.50 for each reminder sent, starting with the second reminder. You reserve the right to prove that the damage incurred is less. Further claims remain unaffected.
For entrepreneurs: In the event of default in payment, we reserve the right to charge you the statutory default interest in the amount of nine percentage points above the base interest rate, as well as a flat fee of 40 euros. Further claims remain unaffected.
7.3 Payment methods
The following payment methods are available in our shop.
PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, identify yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order has been placed. You will receive further information during the ordering process.
PayPal can offer registered PayPal customers who have been selected according to their own criteria further payment options in their customer account. However, we have no influence over the offering of these options; further individually offered payment options affect your legal relationship with PayPal. Further information can be found in your PayPal account.
Credit card
During the ordering process, you provide your credit card details. Your card will be charged immediately after the order is placed.
Amazon Pay
In order to be able to pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. Kennedy, L-1855 Luxembourg (“Amazon”), you must be registered with Amazon, authenticate yourself with your access data and confirm the payment instruction. The payment transaction will be carried out by Amazon Pay within one bank business day after the order has been placed.
Amazon Pay may offer registered Amazon Pay customers who have been selected according to its own criteria further payment methods in the customer account. However, we have no influence on the offering of these modalities; further individually offered payment modalities affect your legal relationship with Amazon Pay. You can find more information on this in your Amazon Pay account.
Apple Pay
To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out immediately after the order has been placed. You will receive further instructions during the order process.
Google Pay
To pay the invoice amount via the payment service provider Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”), you must be registered with Google, have activated the Google Pay function, authenticate yourself with your access data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. Further information will be provided during the ordering process.
Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden (“Klarna”), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise specified below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will find further information in the respective payment option and during the ordering process.
Purchase on account via Klarna
The invoice amount is due 30 days after the goods have been shipped and the invoice has been received.
Klarna can offer registered Klarna customers who have been selected according to their own criteria further payment options in their customer account. However, we have no influence on the offering of these options; further individually offered payment options affect your legal relationship with Klarna. You can find more information on this in your Klarna account.
Klarna Credit Card
You provide your credit card details during the ordering process. Your card will be debited by Klarna immediately after the order is placed. No address or credit check is carried out.
Klarna direct debit
You issue Klarna a SEPA direct debit mandate. Klarna will inform you of the date of the account debit (so-called prenotification). The account will be debited after the goods have been shipped.
Installment purchase through Klarna
You can pay the invoice amount in monthly installments of at least 1/24 of the total amount. The minimum installment is 6.95 euros.
Klarna can offer registered Klarna customers, selected according to their own criteria, further payment options in their customer account (e.g. interest-free installment plans). However, we have no influence on the offering of these modalities; further individually offered payment modalities affect your legal relationship with Klarna. Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking account, identify yourself accordingly and confirm the payment instruction. Your account will be debited immediately after you place your order. You will receive further instructions during the ordering process.
Shopify Payments
We use the payment service provider “Shopify Payments”, 3rd Floor, Europa House, Harcourt Building, Harcourt Street, Dublin 2. If you choose a payment method offered by the payment service provider Shopify Payments, the payment will be processed by the technical service provider Stripe Payments Europe Ltd, 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland, to whom we pass on your information provided during the ordering process together with the information about your order (name, address, account number, bank code, possibly credit card number, invoice amount, currency and transaction number) in accordance with Art. 6 (1) point b GDPR. Your data will only be passed on for the purpose of processing payments with Stripe Payments Europe Ltd. and only to the extent necessary. SEPA transfer (prepayment)
If you choose the SEPA transfer payment method, the payment will be processed by the payment service provider Mollie B.V., Keizersgracht 313, 1016 EE Amsterdam, Netherlands. After completing your order, you will receive the necessary payment information by email. Please transfer the invoice amount to the specified account within 7 days. Your order will only be processed after receipt of payment. Mollie provides special bank accounts in Germany, Belgium, France and the Netherlands for the SEPA transfer. This allows you to transfer the amount to a local IBAN in these countries.
Cash payment upon collection
You pay the invoice amount in cash upon collection.
8. Right of withdrawal
Consumers are entitled to the statutory right of withdrawal as described in the cancellation policy. Entrepreneurs are not granted a voluntary right of withdrawal.
9. Transport damage
The following applies to consumers: If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and contact us immediately. Failure to make a complaint or to contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, by doing so, you will help us to assert our own claims against the carrier or the transport insurance company.

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
13. Final provisions
If you are a businessperson, German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the contractual relationship between us and you is our place of business.
Should individual clauses of these terms and conditions be wholly or partially invalid, the rest of the contract remains valid. Insofar as individual clauses are invalid, the content of the contract is based on the statutory provisions.
